Additionally, it is unlawful for any person who has a serious criminal record, including but not limited to assault, battery, burglary, arson, domestic violence, human trafficking, sexual assault, kidnapping, hit and run, and vehicle and sex crimes to search for, procure, or view the contents of another individual’s home, apartment, car, or other real property, including but not limited to communications devices, equipment, tools, memorabilia, guns, or ammunition, without written permission from such other individual.
The California Civil Code also expressly authorizes parents, guardians, and legal representatives of child pornography victims to prevent any child from accessing materials depicting child pornography from visiting any place on-line that is accessible by minors. In addition, the applicable law also allows school employees to inform students about the nature of child pornography, and the fact that it is illegal to possess such materials in the school. Additionally, the law clearly states that it is unlawful for any person to knowingly exhibit in public any visual depiction of nudity or sexual activity. In instances where an adult is caught in the act of viewing child pornography, the individual could face significant consequences, such as a possible loss of current jobs, fines, and possibly jail time.
